How to fight Subaru Of America to pay for a warranty repair?
I noticed some grinding in first gear a few months ago. My local subaru dealer checked it and said it would take $850 to open up my tranny and that will decide weather or not I have a problem SOA will pay for. I've got a 100,000 mile warranty with only 65000 miles on the car. The service guy told me that it has an 80% chance of being covered just as long as I have not abused the car. I brought it in feeling confident that I have not abused this car. Hell, there aren't any engine mods and I don't race. So I find out today that The dealer has sent all the findings and info to SOA and they will decide weather or not it will be a warrany repair.
If not I will have to pay the $850, the rental car costs, and the costs of the repair which can be up to 2k.
So what is with the "deciding" on weather to pay or not. Shouldn't it be covered as long as my car is under warranty?
What can I do if SOA refuses to pay and I still want to fight it. Should I pay first and fight later, ore fight it now.
How would I go about this. Do I need to speak to SOA or a lawyer first. Should I go to the dealership for more info and take pictures of the engine first?
I know I sould only worry about this IF they refuse payment but the Service guy made me feel a bit uneasy.

I'm in a similar boat. First gear on my car has been randomly grinding from a dead stop since ~25K miles. I'm at 52K now. I've taken it into the dealer once, and they could not reproduce the problem. This is understandable, as it does happen randomly. I'll try for a warranty fix again before 60K. If they don't fix it, I will scratch Subaru off my list of companies I'm willing to do business with. As much as I like the new Legacy, in a couple years when I'm ready for a new car, there will be other awd cars on the market to compete.
