I think it's time for the FXT...
So Saturday night around 8 pm, my wife, daughter and I were waiting for the opposite traffic to pass and turn into our driveway and BAM... A truck hit us, he's says he had something in his eye and when he looked up it was too late to react and hit us going about 40mph... We were fine, just sore from the hit, and my 2 year old daughter was more sad about the Forester than anything, she kept saying "oh no my suby got crashed, oh no more suby".... So anyways, I got the police report and everything, just want to know what I gotta do next...

crazy. happy to know of no serious injuries. Make sure you pay attention to your daughters level of anxiety in the car for a little while. At times she may be a little bit panicked or have a bit of a behavioral change when you have to travel. Common side effect.

Daaaamn that looks a lot worse than my accident, glad to hear you guys are okay. Hopefully you get everything sorted out man.
You guys might wanna go see a doctor or chiropractor just to be safe. Aside from that, you'll need to report this to your insurance, get in touch with the other guy's insurance (your insurance should do this for you but might not), and fill out an SR-1 form with the DMV (only required if there is injury/death or damage above $750.. that looks like it'll cost more than $750 ).

Contact your insurance company then contact an attorney specializing in personal injury. A year ago my wife was rear-ended in her Legacy GT by a teen age girl in a Ford truck. Our insurance company was great but the girl's insurance sent us a 50 page form. We were told that unless we returned the form in two weeks we would forfeit any claim. We contacted an attorney and he took over everything. The attorney got my wife to a doctor who found she had a fractured vertebra and a bulging disk, which was verified by our regular doctor who didn't want to do a MRI in the first place. Unfortunately the girl had the minimal required insurance and when the attorney talked to them they sent him a check for the coverage the girl had. Our insurance company had to make up the difference for medical and car repairs. I will never attempt to deal with an accident by myself again.
