Well, its somewhat both, but mainly the stations. The station should have made it completely clear that there was a risk of water intoxication or other health risks or the information should have been made readily availabe to the people playing in the contest (which it didn't sound like it). The husband is probably looking to compensate for lost wages because of his wife's death, she might have been a contributor to her families income and the result of her death has put a financial hardship upon the family. Personally, the reason I don't believe its her fault is because she only went into the contest on the conditions of what the station had told her of the contest prior to the start of, which probably didn't make the risks very apparent. The typical person can't assume all the risks in the situation, it was the stations responsibility to have researched all the health and safety aspects before undertaking the contest, and not the contestants. At least that's my standpoint, which comes from the industry that I work in which is heavily health and safety oriented. In my job you have to identify EVERY potential risk before you go on the jobsite, and that includes liability for errant parties that might wonder onto your jobsite and hurt themselves on your equipment. You are ALWAYS liable, even for stupid idiots, and that's what the radio station should have thought of.

Not the stations fault.

What if they had a contest that said anyone that shows up to the station wins and some fool gets run over by a car when they cross the street? Some responsibility has to rest on the contestants. We should outlaw water instead.

I think street racers and muderers are a different issue. I doubt she understood what she was getting into or even what water intoxication was, hence the fact that she drank too much water and died from it. Its not like she knew that it was going to happen, if she knew the risks (which I am sure she did not), and she did it anyways, then yeah, she's a ****ing idiot and the husband has no right to seek compensation, but that isn't the case here from the facts that I've read about.
