Totalled?
Ok, so I crashed the car.. slid across all lanes of traffic and then the rear drivers side panel hit (or I should say bounced off) the concrete guard rail... the frame is bent. obviously bent... the trunk overlaps the now smashed out tail lights by like an inch and there is an obvious gap on the drivers side rear door but not on the passangers side... but the insurance company and the frame and body place insists that it can be straightened and fixed. I am very leery of this. and then the body shop says that they are basically just going to find another complete rear clip (end) and replace mine with that. like a used one... I am VERY leery of that! Does anyone have any experience with this sort of stuff? is this standard procedure or do I have reason to worry?

Ouch! That makes for a real bad day.
I would really fight to get the car totaled. I believe once a frame is bent, thats it. It will never be the same, no mater what they say. Fight them hard.

Who is your insurance company? Some Insurance companies allow used OEM and aftermarket while others insist on new OEM.
It is normal practice to cold pull to straighten a unibody when the damage is minor but without seeing inside the trunk and the rear differential and strut mounts its hard to say how extensive the damage is. I can’t tell if your car is a 02 or 03 but if the repairs reach a point of 75 to 80% of the value of the car they will total it.
If your insurance company insist on repairing the car be sure and take it to the best body shop you can and make sure they stand behind there work. A reputable shop will warranty their work and address any issues you have with the repairs. Good luck.
