clutch shudder TSB vs warranty
OK, I've spent the last hour or so going over the clutch shudder topic and have a question or two (or more).
I've seen several different answers on whether or not the TSB will be covered depending on mileage. I'm deployed in the sandbox, but will be home in just over a week. My car has the problem (02 wagon) and I have about 50K+ miles.
My question is basically, since this is a known defect, but not a recall, what is the dealer's obligation? Do they have to fix the problem regardless of mileage? I've seen some say 3/36K coverage, others have listed 6/50K, while others have posted 6/60K. Seems like warranty and TSBs go hand in hand to some others say no.
I don't have any idea if my local dealer will give me any guff about it, but I'd like to have some firm ground to stand on if they do. I do have a copy of the TSB, but it doesn't address any mileage issues other than the 30K flywheel issue.

Wear Item Limited Warranty
Wear item coverage for all models is 3 years or 36,000 miles, whichever comes first. Items covered include brake pad/shoe linings, clutch disk linings, and wiper blades.
I'm thinking that unless the dealer really likes you, the odds of getting it covered under warranty are pretty slim. A TSB is just Subaru's way of passing on how to fix an issue - it is not a recall, and is not something which the dealership has to eat the cost of if they don't want to.
The warranty is 3/36 bumper to bumper, and 5/60 for the power train which consists of (again, from the Subaru site for the '02 model year):
Engine block and all internal parts
Cylinder heads and valve trains
Oil pump, oil pan
Timing belts or gears and covers
Water pump
Flywheel
Intake manifold
Oil seals and gaskets
Torque converter
Electronic transmission control unit
Transaxle seals and gaskets
Axle shafts and constant velocity joints (except boots)
Propeller shaft

Thanks for the info. Mainly was interested in the fact that I guess the dealer doesn't have to do this if they don't want to...kinda sucks in my opinion. Seems like this is a factory flaw that should be fixed. It really doesn't seem to me that it's wear related, but I'm sure they can always argue that point. Since I live in Kansas, I think I'll look up the dealer in Lawrence. I saw someone there had some luck dealing with them if my dealer gives me any hassle.

Yeah, that's what I mean...I have the paperwork, but if I take that in and say fix it, are they obligated to do so? This is a really confusing issue to me. If I show them that and they say sorry, your warranty on the clutch ran out at the 36K mile point, are they correct? I'm still not home yet, so I guess I'll see what they have to say when I try it. That's why I was asking...with a TSB, do they have to fix it? It's really not a warranty, it's a factory defect that only applies to certain cars. This is probably why they don't do a recall, otherwise they'd have to fix them all. I would think though, if this applies to your vehicle, they should have to fix it free of charge. We'll see...
