Breach of warranty, breach of oral contract, and violations against the uniform commercial code.
Long story short, my subies under powertrain warranty and the engine blew. No mods or anything. I'm 99% sure the head gasket went and the block got pumped full of air causing a hot spot over a cylinder, and completely blowing the motor, and because temp senders in cars measure water temp, and not air, I had no idea that anything was wrong before it blew, just one of those things that happened on the freeway. Towed my car to the closet dealer and after argueing with them about warranty they finally said that they would order a short block and whatever else i needed to make it right. I shook on it thinking that I wasn't getting screwed. They pulled my motor out, took it apart, then told me that there was so much damage inside of block that there was no way it could have been caused by a defect. Then they took every last bit of by engine except for the block and put it into boxes inside of the car, except for the block, i was told that wouldn't fit in the back seat. so they half assed bolted it back into the engine bay. They said to remove the car from their premises before they start charging me a storage fee.

That is messed up. Did you try contacing a regional office or SOA to try and rectify the situation with a Subaru representative higher up than the dealer reps? If not, I would do that first. If that does not work, I'd say that this is definitely a cause for legal action.
Take plenty of photos, keep any and all documentation you might have gotten at the dealer (like the service sheet they should have given you at the end of that tear-up job they did on your car). Show or send copies of these (keep the originals) to SOA or a regional office and see if they can do something for you. Oftentimes that is all that is necessary to set things right.
Another thing you might want to look at is your state's lemon laws. If your vehicle qualifies as a lemon, you are entitled to certain legal rights which will definitely help you out.
I hope you can get this straightened out w/o legal action. Good luck.
