very long story; anyone with ebay experience please help!

i recenly bought a brand new aps sr55 off of ebay for $890.01. the seller had a pic up of a dr55 so i mentioned that to him, and asked for a pic of the real turbo, i also pointed out that he stated free shipping but at the bottom it said that shipping was $20.00. after i won the auction, he emailed me asking for payment asap. he kept asking me if i was sure i really wanted it cause he had someone else that wanted it if i didnt. i told him i did and that the banks were closed that day and the next and i needed to make a deposit before i sent paypal, he said ok just pay asap. i sent payment 2 days after the auction ended, right before i paid i sent an email asking what the total was going to be with the shipping insurance ... cause i wanted it insured for its full value ($2200) he just said i sent over an invoice pay that asap, so i did, after that, which was last tuesday i didnt hear from him for a week, i sent emails... everything. i finally heard back from him today and he said that i need to stop my payment to him and get my money back from paypal and that he tried to refund me my money earlier but he was $6500 overdrawn and he couldnt...(funny this is his ebay totals from 12/29 -present are $5749.01) i wrote him back asking why i was stopping the payment and that i still wanted the turbo. then i checked auctions already ended. at the time the auction was going for the sr55, he was selling another sr55 and two fp greens, 1 hour and 30 minutes after those auctions ended he posted another auction for a sr55, this time with the real picture (the one he sent me to my email) it had a buy it now for 1099 and ended the next day with buy it now. what can i do? an ebay auction is a legally binding contract, isnt it? i want this turbo more than i want my money back can ebay legally make him furnish me with that turbo, or the money to buy the same turbo? where do i go from here? what should i do besides post bad feedback. thanks for any help and thank you for reading. -norm

I would report it to paypal. most likely his guy is trying to run a scam.What is his seller rating?

I can ask my room mate when he gets back from class. He's a crazy eBayer and even helped start a business around eBay. Usually, a way that works, is to get their phone # from eBay (it's listed under contact I think) and to call him. Sometimes even threatening to get lawyers involved will scare them enough to get them to comply to the sale.

honestly i thought i got lucky with the bidding i went on last minute and bid an odd # and beat everybody out his seller rating was 37 1 neutral and 1 negative both with him as the buyer not the seller ive contaced the other ppl that bid on the other aps sr55's and fp greens and they are saying the same thing this guy scammed me so we will get to the bottom of this and i will get lawyers involved if i have... just to make a point.

well first thing i would do is call paypal and see what you can do to get your money back and then next report him on ebay so other people wont get scammed.

Get your money back ASAP. This sounds 95% like a scam. Get your money back while you still can and don't worry about losing out on a "good" deal on the turbo.

not a scam. he basically just sold the same turbo in another auction to a HIGHER bidder. of course he is goign to sell to the other person. and yes, that is against ebay policy.
it would be too much of a hassel for you to MAKE HIM sell to you.
i advise you to get ur money back, and move on. dont want to not be able to get ur money back and have no turbo to show for it.
plus.. ebay turbos are faulty. many people have gotten them, gotten them installed only to find that it has overboosted, abused and parts are failing.

you don't want this guy's turbo after this stuff anyway..you don't even know what kind of shape it's in. Get your money back from paypal, report the guy a scammer, and move on.

Just wondering...did you get your money back? Hmm...wonder how he got overdrawn $6500...doesn't sound right to me at all...

the turbo was brand new, ive contacted the guy that won the other auction and the guy is doing the same thing with him to ive already contacted ebay and paypal everything is in process of being dealt with ... his id is webstore36

You go through the Ebay dispute process. Report that he hasn't sent the item etc.
