If you take it to small claims court, winning is seriously only HALF the battle. Even if you win, good luck getting your money in a timely manner, or even at all.

Very good point. We watched a video about small claims court in my Anthropology class last year and its really not worth it even if you win

Forget about it. Fix it to it's original color and move on. You said that you will sell the car, so why bother with different color. Also, sounds like you didn't know that the tree would break loose like that until now. I think you will lose. Nothing much to back up your case. Get yourself full coverage insurance next time. I hope total $ wouldn't be too much.

Ya, the small claims court could be a miss cuz even if I win he doesn't technically HAVE to pay. I hope he does. I really hope he settles. So here's the story behind it. Over the summer we had a tree in our backyard fall. My neighbors and everyone in the neighborhood was aware of this and concerned. We spent a few thousand dollars in tree removal and tree trimming to make our home safe from tree damage. Our neighbor was well aware of what we were doing yet he made no effort to trim the trees on his property. I don't know if that will count as negligence but I will let him know that fact. I will try to talk with him before then and hopefully settle. The guy is a real dick though and I have no problem making his life miserable as an "act of god." He still hasn't even cleaned up his trees off my propert so i'm thinking i'll give them back to him into the middle of his driveway.

I also found out there is a nice big dent in the roof to. FML and my spacers came so I can finally mount my enkeis...too bad that's not gonna happen for a while.

I'm thinking of selling, if I don't sell it, I want a new color, but if I do, i'll keep it blue. At least the car will look like new again. I think all the money i've been saving by being on liability is still outweighing the cost of this damage. Plus my deductible and rate were ridiculous anyway despite having a perfect record.

Some nasty dents in the fenders, smashed windshield, broken pass. mirror, and a nasty dent in the roof. It's aluminum so it's warps and bends easily so it's not easy to repair. A pair of new fenders runs $400. The roof is tough to. Plus paint. The bumper got all it's tabs ripped out to so that has to be replaced.

Ya, I always try to be nice to him, but I can tell he doesn't like me...probably because i'm a young person. (he's an old man).

Honestly, I think he should be worried about living next to me, and not the other way around. lol I'm moving soon anyway.
