Well, the video sucks as I thought it would. He looked like he was squirming around, and from the looks of the situation it looked chaotic to say the least.
I can't draw a solid conclusion, but I can say this: if you're out acting like a jackass to the point where a cop draws his gun on you, puts you face down on the ground and needs several other officers to contain you then this sort of thing can happen.
I'm not losing any sleep over this, it didn't look malicious.

Was it purposeful deadly force or an accidental discharge? If it is the latter then I stick to what I said above. If the officer drew his weapon, aimed and shot the guy in the back then he should fry.

Drew his gun thinking it was his taser
After watching the video, I'm willing to bet that the officer meant to draw his taser. Instead drew his gun, put it to the guys back and pulled the trigger. After he shot, he got up, put his hands to his temple as if to say, "Oh fiddlesticks!"

Level of force was kinda jumped on that one.. "jumped the gun" sooo to speak.
I always carry a throw away gun for times like these...You know that one you took from some stupid kid a month ago.. Just place it in the guys hands you just shot be accident.. hahaha..... ok j/k

That guy's family just hired the Johnnie Cochran of the Bay Area. John Burris is a heavy hitter who specializes in cases like these. I foresee that BART cop losing his job and possibly standing trial now. Not to mention the millions of dollars the department will most likely pay out to the family in a settlement.
I wonder if this cop is the same guy that shot at that moving truck two weeks ago.

Just watched it a couple more times (recorded on vcr ) The cop must've told the other 2 cops restraining the victim to let go, because both let go at the same time and that's when the cop shot him.
