Yeah right. You wish that's all he'll get. With the evidence and eyewitnesses against him, there's no way he can beat this case at trial. He's most likely going to plead guilty to a 2nd degree Murder and serve 5-7yrs.

I think with all the media coverage, it's going to be very difficult for them to find a non biased jury.

Not only that, the DA sounds like they're trying to make an example out of him. He'll do some time for sure.

I wouldn't be surprised to see this trial get moved somewhere else. And I'd be surprised to see him get 2nd degree. Voluntary manslaughter maybe.

Have you seen the bart security footage? Heard police witnesses?

I'd be surprised if he gets sentenced to more than 3-5 years and he'll end up in the posh wing with a PS3 and a TV. If he's wise he'll educate himself for a change of career.

Not all of them were smoking rocks. IIRC, there was that one young Caucasian girl that took the cell phone video. She seemed more than willing to talk about what she saw...

yeah I don't think there will be a witness problem.

I think the biggest problems will be.

Defense.
Witnesses.
Publicity. (unbiased jury)
yellow taser tip, cross carried
video is powerful and one is pointed strait at them and very clear
2 years on the force (young/inexperienced)

Prosecution
Depending one what they go for... proving GROSS negligence and/or criminal intent.
If the BART video shows something we don't see now
He's a cop. Inexperience could play in favor.
He's cooperating and showing remorse.


I wonder if there is still and opening for a plea deal and staying out of court and the media...

very true. Was mostly thinking of having to fire on someone. I know I could but I don't think I'd take joy in it.

My brother in law is a LEO in fresno and he has to quite often.

His partner shot someone not to long ago.
