no doubt stupid on cops side, but i saw the kids friends on the news...they look like the type to be involved in this.

The first one said "iono man ya knaw i mean?" lol that was seriously what he said to the reporters question. The second was wearing a hood and sounded scary.

lol i dont care how people are on the inside, i judge on appearance...i mean when im in a dark alleyway at night at least.

reminds me of the Seinfeld episode where Jerry's grandma runs into some hard lookin guy looking for the bank, and she gets really scared...then the hard guy totally comes out of character and gives her directions in the politest way possible LOL some people are like that tho...some

Can someone tell me how you make a cell phone call and chat while people are beating the crap out of you? According to the girlfriend, he said, "They’re beating me up for no reason. I gotta go.' And I heard the gunshot. I didn't want to think the worst". Not sure about you, but if this is what happened, it tells me that he was NOT restrained, or how could he be chatting it up with his girl?? Anyone? Sounds to me like there are a few loose ends on this one, and there's no slam dunk - on either side.

Well I know that he didn't deserve to be shot, but being a father he should of been home with his kid. He also should have been more responsible in his decisions. Maybe think twice about resisting, assuming he did.

The same goes for people who die from getting tazered from the cops. If you listen to the cops and do what they say, you wouldn't be getting zaped.

It would be justified if the suspect was unhandcuffed and reaching for officer's gun. But it sounds like it was accidental discharge. Do they even carry taser?

Honestly an accidental discharge is worse than if he just shot him. Thats ridiculous.

if a cop cant handle a gun, they really dont deserve to be a cop, no excuse, at all, its a life or death situation and they need to be fully aware of what a gun can do. accidental discharge my ***.

That many witnesses, confiscating video cameras... I'd have to say that the most likely scenario is that the officer shot him when there wasn't a need to, which means the officer killed a man they didn't need to.

"oh well" doesn't work. That man needs to have his badge taken away and put on trial for the guys death. Simple as that.

And if someone there ends up giving video, cause there could just be someone with a cell phone camera or something, and it shows it as such, that cop better be on a damn trial.

So many witness accounts, witnesses who don't know that man, said he was restrained and on the ground.

Now, yes, he should have been home with him family, but he didn't commit a crime, he didn't kill someone on BART, he was in a big argument with some other guys, at worst a fist fight. None of the guys had weapons of ANY kind, where is the justification for lethal force?!

i was riding on bart back from sf this same night at around this time. i was going to richmond though, so we wouldn't necesarily pass fruitvale. i do remember them announcing that they had closed the fruitvale station and alot of people were pissed because that was their stop and they were told to get off at lake merritt and find another way home.

several witnesses sent videos of the incident to news agencies. I just saw 2 videos from different perspectives and it looked like the cop shot him while he was laying on ground face down.

Basically the cop was on top of him while 2 other officers held the victim and the cop just decided to shoot him in the back He wasn't handcuffed when he was shot, BUT 2 other officers were holding him so he posed no threat at all.

After he was shot, then they handcuffed him

Forgot to mention, it wasn't an accidental discharge, the cop drew his gun and fired on him.

Here's one of the videos that doesn't show much, camera turns away before he gets shot.

Can't find the other video to post here, but watch KTVU news at 10 pm or something and they should air the video that clearly shows the cop shooting him in the back. The witness was inside the bart train and shows the whole thing.
