seems like an adrenaline controlled moment. I wonder what the full story is though, since the article didn't state what was going on on the train that caused police to be called in the first place.

Pathetic...
Man should be locked up.
No reason to have a gun out and pointed at someone whos sitting on cuffs... If he tries to get up or run, swat his *** with a baton, taser him. What the **** is he doing pulling a gun out when he's not ready to pull the trigger. If you are going to pull out and aim your firearm, you better be willing to deal with any and all consequences.
Something tells me this piece of **** shouldn't have ever become a LEO...

At least there's one more criminal off the streets. The guy was probably taunting the officer...
...too bad he was such a bad shot that it took hours for him to die, though. I'd fire the officer for being a bad shot.

Yeah, but the severity of the crime (whatever it was) didn't quite rate a long, drawn out, suffering kind of death.
Not like he was killing, mugging, or raping someone or something. He probably tried to kick the officer or something, and the officer wound up discharging his weapon. In a large enough crowd environment, it was more than likely an accidental discharge...
...but I'm wondering what this "poor little innocent father of one" was doing out at 2 a.m. causing trouble.

This is all that is known right now:
"BART officials said there was a report of some kind of altercation on the train after it left San Francisco. Because of that report, police met the train in Oakland to deal with the raucous.
No one is saying what caused the officer to shoot the man."

OAKLAND, Calif. -- A man who was shot by a BART police officer while lying on his back in cuffs at the Fruitvale station in Oakland Thursday morning has died from his wounds, according to family.
22-year-old Oscar Grant was shot at the Fruitvale BART station during an incident at 2:15 a.m. where BART police were waiting for an arriving train to address a reported altercation between passengers that had started on the train at the West Oakland Station.
The Fruitvale station, located at 3401 E. 12th St., was closed at about 2:15 a.m. because of the incident, BART spokesman Jim Allison said.
Witnesses who were on the scene said several individuals were detained and restrained with zip tie handcuffs. Grant was among the detained men.
Grant's girlfriend says she talked to him just before he was shot.
"All I know is I heard a loud pop," explained the girlfriend. "I thought it was a gunshot. My last phone call he said 'They’re beating me up for no reason. I gotta go.' And I heard the gunshot. I didn't want to think the worst"
Several witnesses who did not know Grant told KTVU they saw him laying on the ground already restrained when the shooting happened.
"He had the zip ties around his ankles and wrists," said one witness.
Grant was transported to Highland Hospital and underwent surgery, according to family members.
In the hours that followed, friends and family members gathered at the hospital, offering each other support and worrying about his survival.
Grant's family says his lungs were damaged in the shooting when the bullet went through him and then ricocheted off the ground and re-entered his body. Family members confirmed that Grant died from his injuries late Thursday morning. He leaves behind a four-year-old daughter.
KTVU spoke to one young man at the incident who says he got the entire shooting on tape.
He says BART police confiscated that tape, but says the video shows the officer pull his gun and fire two or three seconds later.
A police investigation into the shooting is ongoing.

i dont know the whole story so i wont pass judgement..... but let me clarify some things.
do we know if he was in the process of being handcuffed........ in which lethal cover may be justified
im thinking its kinda like the youtube video... maybe he had his finger on the trigger (which he isnt trained to do)
im not passing judgement, just throwing out some theories.
i dont know who was in the wrong or why it was discharged. pointing your gun at someone while they are being handcuffed is nothing new.

At a Thursday afternoon press conference, BART spokesman Allison said the officer's gun went off while police were trying to restrain Grant.
Authorities said they were still investigating whether the gun was fired on purpose or accidentally. Allison did assert that, contrary to the claims of witnesses, Grant was not cuffed when he was shot.
id still like to see the video. id like to know who is telling the truth. id also like to know if he really was FULLY restrained at the time.
