Youre kinda in the situation I was in. Since its 100% his fault, make sure you get the best treatment from his insurance. NEVER tell anyone that you're feeling all better. Dont take the rental car they try to give you, say you need a bigger one. They were going to give me the smallest one, but I talked my way into a standard (then I got upgraded to a GMC Canyon at the rental place). Also say you're going to miss alot of days of work (or that you have depending on when you talk to the adjuster) For my medical/suffering/work missed I got $1770. Just make it seem like all of this is really inconvenient to you, and hint at the possibility of you suing the guy (I straight up asked if I would be able to sue him after I collected all checks from Allstate, the lady went to talk to her supervisor then...) Good luck on yours.

You should be dealing with the insurance of the guy that hit you, unless he has the same insruance company as you do. When I was hit, the only time I talked to AAA was to report the crash. After that, it was nothing but Allstate. As for the time you will be missing, tell them your job requires heavy lifting and you'll need some time off. When I went to get checked out at Kaiser, the doctor wrote a note saying I needed some time off from work so that might have helped some. My neck and back didnt start hurting untill 2 days after the crash, so take it easy just to be on the safe side.

Well woke up this morning, neck is definetly more sore than yesterday. Chances are good I'll have to cancel goin snowboading on Sunday. I'll see about calling his insurace company so I can get work compensation, hopefully it'll work out.

Update:
The car has been dropped off at TGIF body shop in Fremont. My insurance claim has been processed and the car will be worked on once all the parts are in, should be completed in ~3 weeks. Since I was injured, Allstate made me an offer.... I accepted because I'm feeling alot better. So they will be paying me $1788.75 which will come in VERY handy getting my ej20 swap.
