3 alarm fire yesterday in concord was my studio...legal standing?

Hey guys...

Long night last night -- my band had studio space in a building out in concord which suffered from an electrical fire and wound up in a 3 alarm blaze. A couple of my buddies just narrowly escaped. It was a huge operation...17+ fire trucks, ambulances, PG&E trucks everywhere, police hassling us. It was nuts.

Anyway, its looking like all of our equipment is done for, as with many other bands in the building. The place was a POS, was sooo not up to code it wasn't even funny. I'm sure the building inspector's findings will parallel ours.

On what sort of legal grounds would I be able to take the building management / owner to court for negligence on their part for the buildings upkeep, poor electrical practices, absence of fire alarms, smoke detectors, and sprinklers, and so fourth? I had 15k of equipment in that studio alone, not including my band mates.

If anyone has any intelligent feedback, I would be forever grateful. Thanks.

Why did you keep your expensive stuff in a shady place like that?!?! I mean, that's an insane amount of risk if you know the electrical setup wasn't built well.

I heard it's full of studios... what kind of operation is that?

Places like that put good engineers like Aaron out of business

so based on the police hassling, i'm guessing this wasn't a legit studio? what sort of agreement did you have with the property owner and how was it documented?

dig that up and go talk to a lawyer...

consider it totaled and claim your insurance.

code is up to when the building was built, updated etc.

they are not required to have sprinklers, alarms etc, it is up to tenant improvement.

It had multiple practice studios.

I never thought it was bad to the point where it killed the building.

Looking at what if's and why did I do this or if only that doesn't help us, it only makes it hurt even more.

Everything is documented, and legit.

Police were hassling everyone to stay away, and then questioning us and such. My band mates were the first to see the smoke so...

most commericial rentals/leases require tenants to provide their own insurance if i'm not mistaken?

if the place wasnt up to code, you got a chance for some $ but you'll probably have to put in work

good luck...

I think that in order to prove negligence, you'll have to show that you made them aware of the issues with the electrical connections in the building. You'll have to prove that they knew, but did not respond.

In several instances, the landlord must make arrangements to get into the property in order to do maintenance and/or upgrades, and it's something I'm sure they'd document if someone complained. If they didn't make themselves available to allow the landlord to remedy the situation, the landlord would have a legal defense.

I'm sorry to hear about your loss, and truly hope you had renter's insurance on your belongings inside the building.

I know you are renting space to have a decent place to play and probably record a little, but what your landlord was really doing was destroying studio engineers livelihood. It wasn't like 1 or 2 studios right? The news says there was about 10 in there.

Did you have renters insurance?

Aaron (International B) has more equipment is the value of his home, I'd read his response and maybe send 'em a PM. He's knows the ins and outs of being a tenant pretty well due to when he had his studio.

Pwn,

My friends band uses the same place. He was either there when it happened or something because he said he got all the equipment out just in time (his drums).
